Decree No. 2018-1126 relating to the protection of business secrets was adopted on December 11, 2018; it entered into force on December 14, 2018. By introducing various provisions into the Commercial Code, the decree provides details on:
-the content and the legal regime of provisional and protective measures that the judge can pronounce on request or in summary procedure for the purpose of preventing or putting an end to a breach of business secrets;
-the procedural rules applicable when the judge rules on a request for the protection of business secrets during the communication or production of a document and when he decides, for the same purposes of protecting this secret, to adapt the reasons for its decision or the procedures for its publication.
